Status of consumer competitions on social networks Edenred Slovakia

Preamble

The purpose of the statute is to regulate the rules of consumer competitions carried out through social network functions (contributions and posts), especially on the Edenred Slovakia Facebook page at Facebook Edenred Slovakia and on the Instagram profile of Edenred Slovakia at Instagram Edenred Slovakia (hereinafter referred to as the "fanpage") and on all addresses and profiles of third parties on social networks that cooperate on consumer competitions with the fanpage or with Ticket Service, sro (hereinafter referred to as the "competition"). This statute is the only valid document that bindingly regulates the rules of the aforementioned consumer competition (hereinafter referred to as the "statute").

The competition is a promotional competition that is not a game of chance within the meaning of Act No. 30/2019 Coll. on games of chance and on amendments and supplements to certain acts.

The purpose of the competition is to increase public awareness and promote the Edenred Slovakia brand.

  1. Competition organizer and contractual partners:
    1. The organizer of the competition is the company Ticket Service, sro with its registered office at Karadžičova 8, 820 15 Bratislava. Company ID: 52 005 551, registered in the Commercial Register of the Municipal Court of Bratislava III, section: Sro, file no. 132404/B (hereinafter referred to as the "organizer").
    2. The technical implementer of the competition is the company Elite / Monday Lovers, sro with its registered office at Obchodná 58, Bratislava 811 06, Company ID: 36760960, registered in the Commercial Register kept by the Municipal Court Bratislava III, Section: Sro, File No. 45358/B (hereinafter referred to as the "technical implementer").
    3. Individually designated influencer(s) or influencers who will be selected individually for each competition (hereinafter referred to as "influencer" or in the plural "influencers") may appear in individual competitions.
  2. Time and place of the competition:
    1. The competition takes place within a specific time-limited period, which is stated in the relevant competition post, page or other fanpage function and/or on the posts, pages, profiles and other functions of the influencer or influencers' social networks (hereinafter referred to as the "influencer's social networks").
    2. All current information about the competition (news, changes, outages, etc.) is published on the influencer's fanpage and/or social networks in accordance with the statute.
  3. Conditions of participation in the competition:
    1. The competition is open to natural persons with full legal capacity, over 18 years of age, with permanent or temporary residence in the Slovak Republic (hereinafter referred to as "contestants"), who meet the conditions set out in the competition statute and who participate in the competition on the fanpage or on the influencer's social networks through content and/or instructions added by the organizer to the fanpage or the influencer to his/her social network. The competition may be organized using all means available to the given social network.
    2. The competition is not open to persons who are employees of the organizer and technical implementer, nor to the influencer participating in the competition and his employees. Furthermore, close persons (Section 116 of Act No. 40/1964 Coll. Civil Code, as amended) of the persons mentioned in the previous sentence are not allowed to participate in the competition.
    3. If it is proven that the winner is a person who does not have the right to participate in the competition, the prize will not be handed over to him and remains the property of the organizer. In the event that a person who does not have the right to participate in the competition has already accepted the prize, he is obliged, upon a written request from the organizer, to return the prize to the organizer, or to reimburse the organizer for the full value of the prize.
    4. The contestants declare that:
      a) agree to the conditions of the competition stated in the statute
      b) they will participate in the competition in their own name and on their own account
  4. Joining the competition
    1. The contestant will participate in the competition as stated in the entry instructions or in the description of the competition entry on the influencer's fanpage or social network.
    2. Each competitor meeting the conditions according to Article 3 of the Statute may participate in each competition only once.
    3. All persons involved and registered according to Art. 4 of the Statute and participating in the competition for prizes must meet the conditions of participation according to Art. 3 of the Statute. Only a person who has participated in the competition and acted in accordance with the content and instructions of the competition and the Statute and has been designated as the winner by the organizer or influencer may apply for a prize from the competition.
    4. Each competitor who meets the conditions according to Articles 3 and 4 of the Statute can only win one prize in the competition unless the individual competition explicitly states otherwise.
  5. The principle of the competition and how to win:
    1. The principle of the competition is always determined individually in the content of the post or in the description of a specific competition via a competition post on the influencer's fanpage or social network.
    2. The organizer is entitled to exclude from the competition contestants and/or contributions created by them who do not meet the conditions of the competition and/or whose actions and/or content are illegal and/or may be contrary to good morals.
    3. The winners of the competition will always be announced via the fanpage and/or the relevant influencer profile using the functions of the given social network, e.g. in the form of a comment under the winners' specific comments under the competition post after the competition ends, etc.
    4. The contestant who wins the competition will be contacted by the influencer or organizer via appropriate means of communication to provide identification, contact and delivery details.
    5. The winners will be contacted via the social network on which they participated in the competition. The winner will be asked to provide their details. The winners agree that the organizer and the influencer may exchange the winner's personal information for the purpose of delivering the prize and the actions related to it. The contestant agrees that he/she will be marked as the winner on the social network or fanpage in a publicly accessible manner.
    6. The data provided by the contestants in the competition serve to identify the contestant, prevent multiple participation of the contestant in the competition, for the purposes of evaluating and publishing the winners of the competition, handing over and delivering the prizes, as well as facilitating the communication of the organizer with the contestants. The contestant's contact details will be used to verify the accuracy and validity of the data provided by the contestant when collecting the prize.
  6. Winnings and prize distribution:
    1. The prize is always published in the description of a specific competition via a competition post on the influencer's fanpage and/or social network.
    2. The Organizer will notify the winner via email or other appropriate means of the prize and the method of its delivery no later than 10 days after the evaluation of the competition and the decision on the winners. If the winner does not respond within 3 days of the notification according to the first sentence, or if the winner provides false or incomplete information, the prize will be forfeited to the Organizer.
    3. The organizer is entitled to choose the method of delivery of the prizes.
    4. The organizer delivers prizes only to valid addresses within the territory of the Slovak Republic.
    5. None of the winners may transfer their claim to the prize to another person. The prize in this competition cannot be enforced in court pursuant to the provisions of Section 845 of Act No. 40/1964 Coll. of the Civil Code, as amended; the exchange of the prize for money or other non-monetary benefits is excluded. There is no legal claim to the prizes from the competition. In the event of any dispute regarding the competition, the decision of the organizer will be final and binding.
  7. Data protection
    1. By participating in the competition and possibly providing personal data, the competitor enters into a relationship with the organizer similar to a contractual one, which forms the legal basis for the processing of personal data in the following scope: name, surname, e-mail, contact telephone number, for the purposes of organizing the competition, publishing the results and delivering the prize. For the purpose of handing over any prize, the necessary personal data in the following scope are processed: name, surname, e-mail, contact telephone number, address.
    2. The rights of the competitor in the processing of personal data are subject to the regime and conditions defined in Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) and Act No. 18/2018 Coll. on the protection of personal data and on the amendment and supplementation of certain acts, as amended.
    3. The personal data of the contestants will not be subject to automated decision-making or profiling and will not be transferred to third countries.
    4. The contestant has: a) the right to access personal data; b) the right to rectification; c) the right to erasure (“right to be forgotten”); d) the right to restriction of data processing; e) the right to data portability; f) the right to object to processing; g) the right to file a personal data breach notification; h) the right to object to data processing based on automated decision-making, including profiling.
    5. The contestant is entitled to object to the processing of personal data at any time, even without giving a reason, in writing to the address of the organizer's registered office or electronically to the e-mail address gdpr.slovakia@edenred.sk. Objection to the processing of personal data results in exclusion from the Competition and loss of the right to win.
    6. The organizer's personal data processing policies are listed on the organizer's website: https://www.edenred.sk/informacie-o-spracuvani-osobnych-udajov/. Contestants can contact the organizer's responsible person in writing at the e-mail address gdpr.slovakia@edenred.sk.
  8. General provisions
    1. The competition organizer is entitled to extend, shorten, interrupt the competition, cancel or change its rules or prizes.
    2. The organizer is entitled to change the terms of the competition according to the first point in order to protect the health, morals and reputation of the contestants, the influencer or the organizer. The organizer is also entitled to change the terms of the competition if an obstacle occurs that makes the implementation of the competition impossible or disproportionately difficult.
    3. The organizer and/or influencer will make an appropriate announcement about such changes on the social network and/or fanpage. In justified cases, the winner may be offered an equivalent prize other than that stated in the competition post.
    4. Any changes to the competition rules shall enter into force upon their publication. Competitions that were started before the publication of these statutes and were not completed as of the date of their publication shall be completed in accordance with the amendments to the statutes in force at the time of the start of the competition.
    5. In the event of suspicion of abuse of the competition rules by a competitor, as well as in the event of a competitor's behavior contrary to good morals, the organizer is entitled to unilaterally exclude such competitor from the competition, even without his knowledge.
    6. In the event of a conflict between the provisions of the statute and promotional materials relating to the competition, or any ambiguities relating to the interpretation of the statute, promotional materials or the competition post, the relevant provisions of the statute in their current effective wording will apply and take precedence.
    7. The organizer will not be responsible for any health insurance contributions and tax obligations of the contestants and the payment of any tax resulting from the prize according to the relevant Income Tax Act No. 595/2003 Coll., as amended.
    8. The contestant agrees to the competition rules and regulations by participating in the competition, and also agrees and undertakes to fully comply with them.
    9. The risk of damage to the prize passes to the winner upon acceptance. The competition organizer bears no responsibility for defects in the prize and any damage in connection with the use of the prize. The organizer is not responsible for any delay, loss, damage or destruction of the prize or incorrect delivery of the prize caused by postal or similar transport to the winner's address.
    10. The competition organizer is not responsible for any non-delivery of the prize caused by the winner using the contact details provided by the winner for the purpose of prize delivery.
    11. The organizer does not reimburse the competitors for any costs they incur in connection with their participation in the competition or in connection with winning the competition.
    12. The Organizer is not responsible for technical problems of any kind, including failure or interruption of telephone lines, failure or interruption of network hardware or software.
    13. The organizer is also not responsible for technical or human error that may occur in the process of administering the competition, nor for damages incurred by third parties as a result of false statements made by competitors in these statutes.
    14. The competitor who provided their personal data is responsible for ensuring that the personal data provided is correct, complete, up-to-date and true.
    15. The Statute regulates the rights and obligations of competitors and entities participating in the implementation of a consumer (promotional) competition carried out pursuant to Section 4, Paragraph 6 of Act No. 30/2019 Coll. on Gambling and on Amendments to Certain Acts.
    16. The Statute becomes effective on the date of its publication on the website.
